1. About these terms
These Terms and Conditions (the “Terms”) govern your use of the FitMatch mobile app (iOS and Android), the web app, this marketing site, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use FitMatch as a consumer, you keep all rights that cannot be excluded or limited under UK or EU consumer law, including the UK Consumer Rights Act 2015, the EU Consumer Rights Directive, and the EU Digital Content and Digital Services Directive.
2. Who may use FitMatch
You must be at least 16 years old to create a FitMatch account. This is the age at which we can lawfully process your personal data on the basis you provide under UK GDPR and most EU jurisdictions without a parent’s consent. Some EU member states set a lower digital-consent age (as low as 13); if you are between 13 and 15 and live in one of those countries, a parent or guardian must give verified consent before you use the Service.
You must give accurate account information and keep it up to date. You may not create an account for another person without authority, and you may not use the Service if we have previously suspended or closed your account.
3. Your account
You are responsible for:
- Keeping access to your device, email, authentication factors, and any passcode secure.
- Activities carried out through your account, unless caused by our failure to use reasonable care.
- Telling us promptly at hello@fitmatch.org.uk if you believe your account has been compromised.
- Using only sign-in accounts, photos, and wardrobe content you are authorised to use.
Authentication and subscription billing are handled by Clerk. Sign-in with Apple or Google is optional; those providers’ own terms apply when you use them.
4. What FitMatch provides
The Service currently lets you:
- Create and manage a private digital wardrobe by taking or uploading clothing photos, including a mass-upload flow with automatic tagging.
- Record style, colour, brand, climate, and occasion preferences.
- Generate AI-assisted outfit suggestions for a given day, occasion, or weather.
- Save outfits to a private lookbook and revisit them later.
- Plan looks for future days on a weekly planner.
- Dictate notes and requests using the voice-input feature.
- Switch between light and dark modes and between supported interface languages.
- Receive push notifications for daily plans, reminders, and saved looks (with your consent).
We may add, change, replace, or discontinue features as the Service develops. If a change materially reduces a paid feature you are subscribed to, we will notify you in advance and offer any remedy required by law.
5. AI-assisted features (EU AI Act, Article 50)
FitMatch uses artificial-intelligence systems to tag your wardrobe items, generate outfit combinations, transcribe voice notes, and synthesise the assistant’s spoken replies. Under the EU AI Act (Regulation (EU) 2024/1689):
- These features are limited-risk AI systems. They are not high-risk under Annex III and do not perform biometric identification, emotion recognition, social scoring, predictive policing, or credit / employment scoring.
- Transparency: outfit suggestions, tags, transcripts, and synthetic voice output are labelled as AI-generated inside the Service.
- No automated decision with legal effect: nothing FitMatch produces has a legal or similarly significant effect on you within the meaning of Article 22 UK/EU GDPR.
- Human oversight: you can override, edit, ignore, or delete any AI output. Nothing you see is a professional recommendation.
AI outputs can be wrong, incomplete, biased, or unsuitable. Outfit suggestions are general styling assistance, not professional, medical, safety, cultural, religious, or legal advice. You remain responsible for what you actually wear and for whether an outfit is safe and appropriate for weather, work, activities, dress codes, culture, health, or other circumstances. Do not rely on FitMatch for safety-critical decisions.
6. Your content
“Your Content” includes wardrobe photos, clothing details, preferences, outfits, saved looks, feedback, voice recordings, transcripts, and other material you submit.
You keep ownership of Your Content. To run the Service for you, you grant FitMatch a limited, non-exclusive, worldwide, royalty-free licence to host, copy, process, analyse, transmit, and display Your Content back to you. This licence exists only to operate, secure, support, and improve the Service, ends when Your Content is deleted (subject to reasonable backup cycles and legal-retention requirements), and does not allow us or our sub-processors to use Your Content to train general-purpose AI models.
You confirm that:
- You own Your Content or have the right to use it.
- Your Content does not violate another person’s privacy, intellectual-property, or other rights.
- Your Content does not contain unlawful, infringing, or harmful material.
7. Acceptable use
You must not:
- Break the law, encourage unlawful activity, or upload material that infringes another person’s rights.
- Attempt to access another person’s account, wardrobe, photos, or data.
- Probe, disrupt, overload, reverse-engineer, or bypass security, except where law expressly permits it.
- Use automated tools, scrapers, or bulk-download methods against the Service without written permission.
- Upload malware, harmful code, or content designed to exploit users.
- Use the Service to harass, exploit, discriminate against, or harm another person.
- Use the Service or any AI output to train, develop, or evaluate a competing model or service without written permission.
- Feed voice input or wardrobe content that contains other people who have not consented to being processed.
- Remove legal, copyright, or ownership notices.
8. Privacy, analytics, and cookies
Our Privacy Policy explains what personal information we collect, how we use it, and the lawful bases we rely on under UK and EU GDPR. It forms part of these Terms. Your wardrobe and lookbook are private and user-scoped; you should still avoid uploading images or details that are unnecessarily sensitive.
We use PostHog for product analytics, session replay, and error tracking, and OneSignal for push notifications. Analytics starts only after you sign in and activate the relevant feature. Sensitive form fields (passwords, payment details) are masked in session replays. You can opt out of analytics and disable notifications in the app.
9. Intellectual property
FitMatch and its licensors own the app, website, software, design, branding, models, documentation, and other service materials, excluding Your Content. We grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended personal purpose while these Terms apply.
10. Fees, subscriptions, and cancellations
FitMatch has a Free tier and a paid Pro tier. The Free tier includes core wardrobe and outfit features up to the limits shown in the app. Pro unlocks higher limits and additional features. Current limits, features, and prices are shown clearly inside the app before you subscribe.
- Pro subscriptions on the web are billed by Clerk Billing (payment processing by Stripe). Pro subscriptions in the iOS or Android app are billed by Apple or Google under their store terms.
- Subscriptions renew automatically at the end of each billing period until you cancel.
- You can cancel at any time in Preferences → Billing (web) or in the App Store / Google Play subscription settings (mobile). Cancellation stops future renewals and keeps your access until the end of the paid period.
- Because Pro gives you immediate access to digital content and services, if you subscribe as a UK or EU consumer you expressly agree that supply begins straight away and you acknowledge that your right of withdrawal ends once the paid period starts, except where non-waivable consumer law provides otherwise.
- Refunds are provided where required by law, by the applicable app store, or as a matter of discretion.
- We may change prices with reasonable advance notice for your next renewal.
11. Service availability and changes
We aim to provide the Service with reasonable care and skill. It may occasionally be unavailable because of maintenance, updates, faults, security work, sub-processor outages, network problems, or events outside our reasonable control. We do not promise uninterrupted or error-free operation. When we make material changes to the Service, we will notify you where required by law.
12. Suspending or ending access
You may stop using FitMatch at any time. To delete your account, use Profile → Delete account inside the app, visit fitmatch.org.uk/delete-account, or email hello@fitmatch.org.uk from the address connected to your account. Verified deletions are processed from active systems within 30 days and from rolling backups within 90 days.
We may restrict, suspend, or close an account where reasonably necessary to:
- Address serious or repeated breaches of these Terms.
- Protect users, FitMatch, our sub-processors, or third parties.
- Respond to fraud, security threats, or legal requirements.
- Stop unlawful or harmful use.
Where possible we will give reasonable notice and, for paid accounts, a pro-rata refund of unused Pro time.
13. Our responsibility
Nothing in these Terms excludes or limits liability where it would be unlawful, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for consumer rights that law does not allow us to exclude.
Subject to the paragraph above and to the extent permitted by law, FitMatch is not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data caused by circumstances beyond our reasonable control. Our aggregate liability to a paying user for a claim connected to the Service will not exceed the greater of the amount you paid us for Pro in the twelve months before the event giving rise to the claim, or £50.
14. Third-party services
The Service relies on third parties, including Clerk, Stripe, Supabase, Cloudflare (Workers, KV, D1, Workers AI), ElevenLabs, Pinecone, PostHog, OneSignal, Vercel, Expo / EAS, OpenWeather, Apple, and Google. Some features may require you to accept the third party’s own terms. We are not responsible for their independent acts, omissions, or availability.
15. App-store terms
If you download FitMatch through the Apple App Store or Google Play, the relevant store’s terms apply in addition to these Terms. For the iOS app, you agree that these Terms are between you and Planbase Limited only, and Apple is not responsible for the app or its support; Apple is, however, a third-party beneficiary of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms for legal, regulatory, security, operational, or product reasons. If a change materially affects your rights, we will notify you at least 30 days in advance in-app or by email, and give you a chance to cancel a paid subscription without penalty before the change takes effect.
17. Complaints and disputes
Please contact hello@fitmatch.org.uk so we can try to resolve a complaint. These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections in the country where you live, and you may bring proceedings in the courts of that country. EU consumers can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
18. General terms
- If a court finds part of these Terms unlawful or unenforceable, the remaining parts continue to apply.
- A delay in enforcing a term does not waive the right to enforce it later.
- You may not transfer your account or rights under these Terms without our permission. We may transfer our rights in connection with a merger, financing, acquisition, or sale, provided your rights are not reduced.
- These Terms and our Privacy Policy are the entire agreement between you and Planbase Limited about the Service and replace any earlier version.
